Document Description
The purpose of the proposed project is to conduct an emergency repair of the IEUA sewer pipelines at this location to prevent a major pipeline breach and released of raw sewage into the environment. This will be done by conducting a slip-line of two unprotected IEUA sewer lines. This action must be implemented as soon as possible to maintain adequate delivery of the wastewater to the IEUA’s Water Reclamation facilities and prevent a damaging discharge of raw sewage into the environment.

Reasons for Exemption
The State CEQA Guidelines provide a series of Statutory Exemptions for actions that have been deemed by the State Legislature to be exempt from (not subject to) the California Environmental Quality Act (CEQA). The proposed emergency repair of the IEUA sewer pipeline that crosses the Union Pacific Railroad tracks in Ontario has been determined to qualify for a Statutory Exemption under Section 15269(b)(c) of the CEQA the statute and the State CEQA Guidelines. Section 15269 exempts “(b) Emergency repairs to publicly or privately owned service facilities necessary to maintain service essential for public health, safety or welfare and (c) Specific actions necessary to prevent or mitigate an emergency. The proposed repair of the sewer pipeline has been determined to not fall under the jurisdiction of CEQA and the State CEQA Guidelines because these activities fall within the scope of the emergency criteria listed in Section 15289(b)(c). Therefore, this action qualifies with the requirements for an Emergency Project Statutory Exemption in compliance with Section 15269(b)(c) of the State CEQA Guidelines.
