Document Description
On June 21, 2022, the Soquel Creek Water District’s Board of Directors adopted Resolution No. 22-14 to award the Contract for the Seawater Intrusion Prevention (SWIP) Well Equipping Project for Pure Water Soquel CWO 20-3000 to McGuire & Hester for equipping of the Twin Lakes Church (TLC), Monterey and Willowbrook SWIP wells, including site civil improvements resulting in three fully functional recharge wells. In addition, the Board of Directors authorized the General Manager to execute a purchase order to McGuire & Hester in the amount of $7,777,385, approved the scope of work from Montgomery & Associates to perform engineering and construction management services during construction and authorized the General Manager to sign a purchase order for a not to exceed amount of $259,997.

Reasons for Exemption
Public Resources Code section 21080, subdivision (b) provides that CEQA does not apply to ministerial projects proposed to be carried out or approved by public agencies. (See also State CEQA Guidelines, §15060(c)(1) [CEQA applies to discretionary actions of a public agency].) Per District Procurement Policy POL500-003, the District must accept the qualifying lowest bid. Accordingly, the adoption of Resolution No. 22-14 is a ministerial action not subject to the Board’s discretionary review.
