Document Description
On April 25, 2022, the Agency’s Board of Directors authorized the Agency’s General Manager to sign the Agreement, relating to the State Water Project Multi-Year Transfer Program with Ventura.
The Agreement provides for the transfer of some of Ventura’s rights to Table A water under the State Water Program (“SWP”). The Table A Water will be delivered to the Agency from the SWP through facilities already in existence when the Table A Water is delivered, such that it will not be necessary to construct additional facilities in order to affect delivery of the Table A Water pursuant to the Agreement.

Reasons for Exemption
The Agreement falls within the Class 1 exemption, which applies to the operation, maintenance, permitting, and leasing, and minor alteration of existing public or private structures, facilities, or topographical features involving negligible or no expansion of existing or former use. (State CEQA Guidelines, § 15301.) Here, the Table A Water will be delivered to the Agency from the SWP through facilities already in existence, such that it will not be necessary to construct additional facilities in order to affect delivery of the Table A Water pursuant to the Agreement. Because this water transfer involves the operation of an existing public facility, and because there is negligible or no expansion of existing use (e.g., the Agreement will not result in an expansion of SWP facilities), the Agreement is exempt from CEQA under the Class 1 exemption.
