Per Section 15301 of the CEQA Guidelines, a project that consists of the "operation, repair, [and] maintenance. . . of existing public or private structures, facilities, [or] mechanical equipment," is categorically exempt from CEQA. (Section 15301). Included as an illustrative example of facilities included witin this exemption are "existing facilities of both investor and publicly-owned utilities," and "minor repairs. . .to existing dams and appurtenant structures." (Section 15301(b); 15301(m)). Here, Tejon Castac Water District, a public water agency, plans to excavate and maintain an existing turnout of the California Aqueduct, an existing water conveyance facility administered by the Department of Water Resources. Thus the project, because it concerns minor maintenance of an existing water conveyance facility, is categorically exempt from CEQA.
